First Steps Nutrition, LLC

These Terms of Service (“Terms”) govern your access to and use of all content, materials, and digital products provided by First Steps Nutrition, LLC (“Company,” “we,” “us,” or “our”).
By downloading, accessing, or using our materials, you agree to be bound by these Terms.
1. Definitions
“Content” / “Materials”: All digital downloads, curriculum, text, graphics, designs, and resources provided by the Company
“User”: Any person, entity, organization, or business who accesses or uses the Materials
“Household”: A single family unit living under one roof. This does not include extended family, friends, co-ops, classrooms, or group settings
2. License Grant (Single Household Use Only)
We grant you a limited, non-exclusive, non-transferable, revocable license to use our Materials strictly for personal use within a single Household.
You may:
Download the Materials for personal use
Print copies for use within your Household only
You may not:
Share, forward, or distribute the Materials to other individuals or households
Upload the Materials to shared drives, websites, or social platforms
Reproduce, resell, sublicense, assign, or redistribute the Materials in any form
This license may not be transferred or assigned to any other person or entity.
3. No Sharing Policy (Important)
This resource is provided free of charge as part of our small business.
Sharing the file directly with others, even with good intentions, harms our ability to continue creating high-quality resources.
If you would like to share, direct others to obtain their own copy through our official platform.
Unauthorized sharing or distribution will result in immediate revocation of access and may result in legal action.
4. Prohibited Use (Commercial and Group Settings)
The Materials may not be used for:
Classrooms, schools, or educational institutions
Homeschool co-ops or group learning environments
Therapy, coaching, or professional practice
Any commercial or revenue-generating activity
A separate license is required for any such use.
5. Intellectual Property
All Materials are the exclusive property of First Steps Nutrition, LLC and are protected by copyright and other intellectual property laws.
All rights are reserved.
6. Digital Delivery and Access
All products are delivered electronically.
We do not guarantee continuous, uninterrupted, or permanent access to any Materials.
We are not obligated to reissue, replace, or maintain access to previously downloaded Materials.
7. Right to Modify or Revoke Access
We reserve the right to modify, update, or discontinue any Materials at any time.
We also reserve the right to revoke access to any User who violates these Terms.
8. Educational Disclaimer (No Medical Advice)
All content is provided for educational and informational purposes only.
Nothing in this material constitutes medical advice, diagnosis, or treatment.

10. Limitation of Liability
To the fullest extent permitted by law, First Steps Nutrition, LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Materials.
11. Indemnification
You agree to indemnify, defend, and hold harmless First Steps Nutrition, LLC from any claims, damages, liabilities, costs, or expenses arising from your use or misuse of the Materials or violation of these Terms.
12. Enforcement and Injunctive Relief
You acknowledge that unauthorized use, distribution, or reproduction of the Materials may cause irreparable harm.
We reserve the right to seek injunctive relief, damages, and any other remedies available at law or in equity.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado.
Any dispute shall first be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA).
Arbitration shall take place in El Paso County, Colorado.
If arbitration does not resolve the dispute, it shall be brought exclusively in the courts located in El Paso County, Colorado.
Each party shall bear its own legal fees unless otherwise required by law.
14. Account and Access Responsibility
If access to Materials is provided via email or link, you are responsible for maintaining the confidentiality of that access.
You may not share access links or credentials with others.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and First Steps Nutrition, LLC regarding use of the Materials and supersede all prior agreements or understandings.
17. Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to internet outages, platform failures, or natural events.
